Phix standard terms and conditions for promotions

These terms and conditions (“T&Cs”) apply to any prize draw carried out by Phix Clothing (Rock N Roller Ltd, 19 Shudehill, Manchester, M4 2AF (“Phix”) via social media including but not limited to Instagram, Facebook and Twitter. Each prize draw shall have specific details on the Prize Draw Page (as defined below) and shall be subject to these T&Cs. Each prize draw is a separate prize draw. No purchase or payment is necessary to enter or win.

1.1. The Prize Draw Page is a page hosted by Phix Clothing where you can access and view the detailed information of each prize draw (including but not limited to, the start and end date/ time, the number, nature, and value of the prize, and the methods to enter) (“Prize Draw Page”).
1.2. Where such details are not specified on the Prize Draw Page, the relevant terms of these T&Cs shall prevail.

eligibility

2.1. To participate in a prize draw you must satisfy the following:

2.1.1. You must be a permanent legal U.K. resident physically residing within the United Kingdom;
2.1.2. You must be at least 16 years old as of the date of entry;
2.1.3. You are not permitted to enter the draw if you are an employee of Phix Clothing, their direct family member or agent, or if you are otherwise professionally connected with the prize draw;
2.1.4. Only one entry per person; bulk entries made by third parties are not permitted; and
2.1.5. You must agree to and comply with these T&Cs; if you do not agree and/or comply you will not be eligible to participate and will be disqualified.

how to enter

3.1. To enter a prize draw you will need to:

3.1.1. Have or gain internet access;
3.1.2. Enter between the start time and end time as set forth on the applicable entry on the Prize draw Page ("Entry Period");
3.1.3. You must complete all required steps explicitly stated on the Prize Draw Page, within the Entry Period.

3.2. Your entry will be automatically submitted to Phix Clothing upon completion.
3.3. Entry is always free (no purchase necessary).
3.4. All entries are subject to Phix Clothing Terms of Service and Privacy Policy, found at https://www.phixclothing.com/pages/terms-conditions and https://www.phixclothing.com/pages/privacy-policy

3.5. An example of some of the steps that you may be required to complete are as follows:

3.5.1. Follow the Phix Clothing official Instagram account;
3.5.2. Find the post relating to the prize draw;
3.5.3. Like the post relating to the prize draw;
3.5.4. Tag 3 of your friends in the post;
3.5.5. Share the post on your Instagram story;
3.5.6. Follow the Phix Clothing Facebook account; or
3.5.7. Retweet the prize draw tweet.

disqualification

4.1. Phix Clothing reserves the right to disqualify any entry made in breach of these terms and conditions or acting dishonestly, including (without limitation) by manipulating codes, generating multiple entries or submitting false information.
4.2. Late or incomplete entries which do not satisfy these terms and conditions will be disqualified and not be entered into the prize draw.
4.3. Non-winning entries in one prize draw will not be carried over into any other prize draw.
4.4. Phix Clothing is not responsible for entries that we do not receive for any reason, or for entries that we receive but are not decipherable for any reason.

winner selection

5.1. All eligible entrants’ names will be placed in a draw and one winner will be selected at random after the Entry Period.
5.2. Within 7 days following the end of an Entry Period, the Winner for the prize will be chosen, Phix Clothing’s decision as to the winner is final.
5.3. The Winner will be notified by Phix Clothing via direct message on the social media platform that they made their entry (“Prize Notification”). For example, if you entered the prize draw via Instagram, you will be contacted by Instagram direct message.
5.4. The winner will be asked to confirm their full name, age, postal address, email address and telephone number to claim the prize(s) and provide proof of identity where necessary.
5.5. We reserve the right to disqualify the winner from the prize draw if you are unable to provide such details.
5.6. Phix Clothing reserves the right to determine an alternate method of notification shall it be required.
5.7. The Winner must claim the applicable prize within 7 days after the Prize Notification.
5.8. If the prize(s) is unclaimed after the time specified, Phix Clothing reserves the right to offer the prize(s) to another winner selected in accordance with these terms.
5.9. If for any reason the winner chooses not to take up the prize or any part of the prize, we reserve the right to ask the winner to confirm this in writing and we will be able to retain or dispose of the prize (or part of the prize) at our own discretion.

prizes

6.1. The winner ("Winner") will be selected in accordance with these T&Cs to receive the prize(s) as set forth on the applicable entry on the Prize Draw Page.
6.2. All details regarding redemption of the prize(s) are at Phix Clothing’s sole discretion and will be provided at the time of notification.
6.3. In no event shall Phix Clothing be obligated to award any prizes other than the prizes specified on the applicable entry on the Prize Draw Page.
6.4. The prizes are non-transferable and no substitutions (including, without limitation, for cash) are permitted, unless otherwise agreed in writing by us.
6.5. The prize(s) cannot be redeemed for cash, cash alternative or any other form of compensation.
6.6. The prize must be taken as stated and cannot be deferred.
6.7. Phix Clothing reserves the right to substitute the prize with one of the same or greater value.
6.8. If the Winner is unable to accept the prize or any portion of the prize for any reason, Phix Clothing shall have no further obligation to the Winner.

7.1. By entering this Prize Draw you agree that we may hold and use your personal data (including without limitation your Instagram handle, name, date of birth, email address, postal address and telephone number) for the purpose of administering the Prize Draw.
7.2. Phix Clothing is bound by the General Data Protection Regulation and the Data Protection Act 2018 and will use your personal information in accordance with our Privacy Policy (https://www.phixclothing.com/pages/privacy-policy) including where necessary, to the transfer of your personal data outside the European Economic Area.
7.3. Where you are the winner, you agree we may disclose your name and country of residence to other entrants of this Prize Draw.
7.4. We do not knowingly collect personal data from children under the age of 13. If you are under 13 do not use or provide any information about yourself including without limitation your name, address, email address or screen name or user name you may use. If we learn that we have collected or received personal data from a child under 13 without verification of parental consent, we will delete that information. announcement of winner

8.1. The name and country of residence of the winner will be made available upon request for two months after the Closing Date. Please write to the address above with a stamped, pre-addressed envelope for these details.

general conditions

9.1. By participating, you agree to be fully and unconditionally bound by these T&Cs.
9.2. An entrant may be disqualified from a prize draw if they fail to comply with each provision of these T&Cs, as determined in the sole discretion of Phix Clothing.
9.3. Participation in a prize draw is at entrant's own risk.
9.4. If for any reason any aspect of a prize draw is not capable of running as planned, or there is any cause beyond Phix Clothing’s control which affects the administration, security, fairness, integrity or proper conduct of this promotion, then Phix Clothing may in its sole discretion cancel, terminate, modify or suspend the promotion or any affected entries without further notice. Phix Clothing reserves the right to offer non-cash alternatives equal or greater to any cash prize where the Phix Clothing is unable to administer any prize won by a participant.
9.5. Phix Clothing is not responsible for incomplete or illegible entries or entries not successfully completed due to input error or a technical fault or interruption (for example a technical malfunction, computer hardware or software failure, satellite, network or server failure) of any kind.
9.6. This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram, Facebook, Twitter, YouTube or any other social media network or platform. By entering this Prize draw you agree to release the social media platform of any liability caused in respect of this Prize draw
9.7. Each prize draw is subject to all applicable laws governed by England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales.
9.8. To the fullest extent permitted by law we exclude any and all liability for any loss, damage or injury occurring to you or any third party arising from your entry into the prize draw or
