Prices/descriptions/availability may change without notice. Images and colours are indicative only. Final characteristics are shown during checkout.

Pricing errors: We may correct inaccuracies and update or cancel affected orders (with refund if applicable) as permitted by law.

Purchasing process

• submit the order to agree to pay applicable prices, taxes and fees;
• receive a receipt at your email.

Methods of payment

Payments are processed by third parties; we do not store full payment details.

• United States orders: Payments are collected by Phix Group International, Inc. and processed via Global-E.
• United Kingdom: Payments are collected by Rock N Roller Limited and processed via Shopify Payments, Klarna and PayPal.
• All other countries outside the United States & United Kingdom: Payments are collected by Rock N Roller Limited and processed via Global-E on behalf of Rock N Roller Limited.

If a payment fails or is refused, we may cancel the order and recover reasonable costs.

Retention of Product ownership

Title passes only upon receipt of full payment.

Delivery

Orders ship to the address provided at checkout. Customers are required to inspect their parcel immediately upon delivery and notify PHIX of any missing, damaged, or incorrect items within 7 calendar days of receipt. Reports made after this period fall outside our carrier investigation window, and PHIX cannot accept liability once this timeframe has elapsed. US orders generally ship from New Jersey; orders outside the United States generally ship from the United Kingdom.

Failed delivery

We are not responsible for errors due to inaccurate addresses or for delays after handover to carriers arranged by the User. Uncollected/undeliverable items may be returned; additional redelivery attempts may incur costs.

Returns & Return Addresses

• United States returns: Phix Group International, Inc., 181 New Road, Suite 304/8, Parsippany, New Jersey 07054, USA.
• All other countries (outside the United States) returns: Rock N Roller Limited, Conavon Court, 12 Blackfriars Street, Salford, England, M3 5BQ, United Kingdom.

User rights

Right of withdrawal (EU)

European Consumers may withdraw within 14 days of receiving goods (or the last item in a multi-shipment). Send an unequivocal statement before the period ends (you may use the form in Definitions).

Refunds: We refund payments (excluding any premium delivery chosen) within 14 days of notice or proof of return. Return goods within 14 days; diminished value from handling beyond what’s necessary may be deducted. Return shipping is borne by the User.

UK right to cancel

UK Consumers have a 14-day cancellation period with rules similar to the EU. Return shipping is borne by the User; diminished value may be deducted.

Brazilian right of regret

Consumers in Brazil may withdraw within 7 days from contract or receipt. Refunds per law; return shipping may be borne by the Owner for assessment where required.

Guarantees

EU legal guarantee

Minimum 2-year conformity guarantee for Consumers (local laws may grant broader rights, including specific French rules).

UK conformity

UK Consumers have a right to goods conforming to contract.

Brazilian legal guarantee

30 days for non-durables; 90 days for durables from delivery. Misuse and non-authorised maintenance excluded. Shipping for technical assessment may be borne by the Owner where required.

Product Safety and Handling

Certain PHIX products, including but not limited to jewellery, accessories, and garments, may incorporate pointed, sharp, or delicate components as part of their design. By purchasing or using these products, customers acknowledge that they must be handled responsibly and kept out of reach of children and pets.

PHIX products are intended solely for external and decorative use. Customers are responsible for ensuring appropriate and safe handling. PHIX shall not be held liable for any injury, loss, or damage arising from misuse, improper handling, alteration, or failure to follow any care or safety instructions provided.

To the fullest extent permitted by applicable law in the United Kingdom, the European Union, the United States, and other territories in which PHIX operates, PHIX disclaims all liability for any direct, indirect, incidental, or consequential damages arising from the use or misuse of any product. This disclaimer does not affect your statutory rights with respect to defective or faulty goods.

Non-Returnable Items (Hygiene and Safety Policy)

For hygiene and safety reasons, earrings and other pierced jewellery items are strictly non-returnable and non-exchangeable once purchased, except in cases where the item is faulty or not as described upon delivery. This policy applies globally, including in the United Kingdom, European Union, and United States, and is consistent with applicable consumer-protection and hygiene regulations.

Customers are required to inspect all goods upon receipt and notify PHIX in writing of any missing, defective, damaged, or incorrect items within 7 calendar days of receipt. Reports made after this period may not be accepted, as we are unable to verify or investigate discrepancies beyond this timeframe. Where a legitimate fault is identified, PHIX will offer a repair, replacement, or refund in accordance with applicable law.

This policy exists to protect customer health and safety, as items intended for body contact cannot be resold once opened or worn.

Liability and indemnification

Indemnification

You agree to indemnify the Owner against claims arising from your use of the Service, breach of these Terms, violation of law or third-party rights, content from your account, or wilful misconduct.

Limitation of liability

To the maximum extent permitted by law, liability is excluded or limited as set out here, except for death, personal injury, fraud, or other non-excludable liabilities. For other losses, liability (if any) is limited to typical, foreseeable damages.

Claims for non-receipt, shortage, or incorrect delivery must be raised within the time limits stated in the “Delivery” and “Non-Returnable Items” sections. PHIX cannot accept responsibility for claims submitted outside these timeframes.

Australian Users

Limitation of liability

Nothing excludes your non-excludable rights under the Australian Consumer Law. Our liability is limited to re-supply or the cost of re-supply.

US Users

Disclaimer of Warranties

The Website is provided “as is” and “as available.” We disclaim implied warranties to the extent permitted by law. Some states do not allow limitations on implied warranties; those rights are not affected.

Limitations of liability

We are not liable for indirect or consequential damages, hacking, bugs or interruptions, etc. Some jurisdictions do not allow certain exclusions; those limits apply only as allowed by law.

Promotions, Discounts & Gift Cards

Promotions/codes are valid as stated and may be amended or cancelled. Unless expressly permitted, offers cannot be combined. Gift cards/store credits are non-transferable, not redeemable for cash (except where required by law), and may expire where permitted.

Fair Use of Returns

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, government actions, customs delays, strikes, pandemics, transport issues, supplier failures, or utility outages).

Governing law

Orders placed outside the United States: Laws of England & Wales; courts of England & Wales have exclusive jurisdiction.

Orders placed in the United States: Laws of the State of New Jersey; courts located in New Jersey have exclusive jurisdiction.

Prevalence of national law: If your local law grants higher consumer protections, those prevail. Switzerland: Swiss law applies to Swiss Consumers. Brazil: Brazilian law applies where the product/service is commercialised in Brazil.

US arbitration & class action waiver

For US purchases, disputes may be resolved by binding individual arbitration in New Jersey, to the maximum extent permitted by law. Jury trial and class action participation are waived where lawful. This does not prevent either party seeking injunctive relief for IP protection. If any part is unenforceable, it shall be limited to the extent necessary to be enforceable.
